NOTICE OF COMPLETION OF CONTRACT & FINAL PAYMENT

 

To all persons, firms, or corporations who have any claim for any work done or materials furnished to Hamaker Excavation, Inc. of Laramie, Wyoming (the Contractor) for the Lake Hattie Outlet Works Rehabilitation Project (hereinafter Project) at the Lake Hattie dam and reservoir in Albany County, Wyoming.

 

You are hereby notified that the Pioneer Canal-Lake Hattie Irrigation District (the Owner) has accepted substantial completion according to the contract documents and the rules and terms of the contract between the Owner and Contractor.  The work in connection with the Project is completed, and the Contractor is therefore entitled to final settlement and payment under the contract.

 

You are further notified that on or after the 25th day of February, 2015, being the forty-first (41st) day after the first publication of this notice, the Owner will pay the Contractor the full amount due under the contract; and in the event your claim is not filed with and received by the Owner at the Post Office Box address shown below, prior to the 25th day of February, 2015, the claim shall be waived as against the Owner and the Project.

 

Nothing in this notice and the approval of final payment by the Owner shall be construed as relieving the Contractor and the Sureties on its bond from any claim or claims for labor and materials furnished in the execution of the contract and construction of the Project, nor shall it have the effect of relieving the Contractor, its agents, subcontractors and material suppliers from the warranties and guaranties set forth in the contract between Owner and Contractor.  This notice is given pursuant to Sections 16-6-116 and 16-6-117 of the Wyoming Statutes.

NOTICE OF FORECLOSURE SALE

 

WHEREAS, default in the payment of principal and interest has occurred under the terms of a promissory note dated May, 3, 2005 executed and delivered by William David Flint and Victoria Jean Flint to Bank of America, N.A., as Mortgagee, recorded on May 4, 2005 as Rec. No. 2005-2930, in the public records in the office of the County Clerk of Albany County, Wyoming; as assigned to Wells Fargo Bank, N.A. as Trustee for the holders of the Banc of America Alternative Loan Trust 2005-6 Mortgage Pass-Through Certificates, Series 2005-6, recorded June 30, 2014 as Rec. No. 2014-3026. The premises that are described in the Mortgage are as follows:

               

Condominium Unit 7, Building N, SUN CHASE VILLAGE CONDOMINIUMS, in accordance with Supplement No. 1 to Condominium Map of Sun Chase Village Condominiums (Building N), recorded December 28, 2004, as Document No. 2004-9170, and subject to the Condominium Declaration for Sun Chase Village Condominiums recorded November 23, 2004, as Document No. 2004-8426, of the Official Records of Albany County, Wyoming;

 

with an address of 611 Mitchell Street, N-7, Laramie, WY 82072.

 

Wells Fargo Bank, N.A. as Trustee for the Certificate-Holders of the Banc of America Alternative Loan Trust 2005-6 Mortgage Pass-Through Certificates, Series 2005-6, through its servicer, Nationstar Mortgage LLC, has served a written Notice of Intent to Foreclose the Mortgage by Advertisement and Sale pursuant to the terms of the Mortgage to the record owner or party in possession in accordance with the statute ten (10) days prior to the first publication of the sale.

 

The amount due and owing on the date of the first publication is $104,659.70 which includes the unpaid principal and accrued but unpaid interest. Interest continues to accrue on the unpaid balance at the rate of $16.14 per day.

 

The property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale and any prospective purchaser should research the status of title before submitting a bid.

 

NOTICE IS HEREBY GIVEN, pursuant to W.S.§ 34-3-101 et seq., (1977 Republished Edition) that the above described property will be at public venue sold by the Sheriff of Albany County, to the highest bidder at the hour of 10:00 o'clock A.M. on the 18th of February, 2015, at the front steps of the Albany County Courthouse.
