Teckla-Osage-Rapid City 230 kV Transmission Line Project

Thunder Basin National Grassland

Campbell and Weston Counties, Wyoming

 

The Final Environmental Impact Statement (FEIS) has been completed for the Teckla-Osage-Rapid City 230 kV Transmission Line Project (the Project). A link to the project information and FEIS is available on the Medicine Bow-Routt National Forest and Thunder Basin National Grassland web site at http://www.fs.usda.gov/projects/mbr/landmanagement/projects. The transmission line is proposed to strengthen the transmission network, improve transmission system reliability, and to help meet future demand for electricity and economic development in the region. The proposal is to construct and operate a 230 kV transmission line connecting the Teckla Substation in Campbell County, Wyoming, to the Osage Substation in Weston County, Wyoming, and the Lange Substation located in Pennington County near Rapid City, South Dakota. The proposed line would run across Federal lands managed by the Thunder Basin National Grassland (TBNG) of the Medicine Bow-Routt National Forest, and the Mystic Ranger District of the Black Hills National Forest (BHNF), as well as lands of other ownerships. Supervisors of the TBNG and BHNF will make the decisions on this proposal for the respective Federal lands they manage.

 

A draft Record of Decision (ROD) for that portion proposed to cross the BHNF and TBNG is available with the FEIS. The draft ROD indicates the decision maker will select Alternative 3, Proposed Action with Route Modifications. The selected route modifications crossing lands within the state of Wyoming are as follows: Modification 3a Fiddler. This modification is on private land which is not managed by the TBNG.

 

The development and analysis of this project was completed pursuant to the National Environmental Policy Act (NEPA). The Project is subject to the Forest Service predecisional objection regulation at 36 CFR 218, Subpart B. The objection filing period will end 45 days following the publication date of this legal notice in the Laramie Boomerang, Laramie, Wyoming. This legal notice is the exclusive means for calculating the time to file an objection. Those wishing to file an objection should not rely on dates or timeframe information provided by any other source.

 

Written objections may be submitted to: USDA Forest Service, Region 2, Objection Reviewing Officer, ATTN: Ken Tu, 740 Simms St., Golden, CO 80401. Objections may be hand-delivered between the hours of 8:00 a.m. and 4:30 p.m. on Federal business days. Objections may be faxed to 303-275-5134, or may be submitted in electronic form to: r02admin_review@fs.fed.us (the second and third characters are zero-two). The subject line should contain the name of the project. An automated response will normally confirm electronic receipt of an objection. However, if a person filing an objection does not receive such a response it is their responsibility to ensure their objection is received in a timely manner. Electronic objections must be readable in MS Word, Rich Text Format (rtf), or pdf format.

Written objections will be accepted only from those who previously submitted specific written comments on the proposal during scoping or other designated public comment opportunities.

 

Issues raised in any objection must be based on those previously submitted timely specific written comments on the proposal, unless based on new information arising after designated comment opportunities.

 

Any objection must meet the following minimum content requirements (36 CFR 218.8): 1) name and address of objector (36 CFR 218.2), with telephone number if available; 2) signature or other verification of authorship upon request (a scanned signature for electronic email may be filed with the objection); 3) when multiple names are listed on an objection, identification of the lead objector (36 CFR 218.2); the name of the proposed project, name and title of the responsible official, and the name(s) of the national forest(s) and/or ranger district(s) on which the proposed project will be implemented; 5) a description of aspects of the proposal addressed by the objection, including specific issues related to the proposal; how the objector believes the analysis and draft decision violate law, regulation or policy, if applicable; suggested remedies that would resolve the objection; supporting reasons for the reviewing officer to consider; and, 6) a statement demonstrating the connection between prior specific written comments on the proposal and the content of the objection (unless the objection concerns an issue that arose after the designated opportunities for comment).

 

Any objection including attachments must be filed within 45 days of the date this notice is published in the Laramie Boomerang. It is the objector’s responsibility to ensure timely filing with the reviewing officer. Timeliness will be determined by the following factors: 1) the date of the US Postal Service postmark for an objection received before the close of the fifth business day after the objection filing period; 2) the agency’s electronically generated posted date and time for email and facsimiles; 3) the shipping date for delivery by private carrier for an objection received before the close of the fifth business day after the objection filing period; or, 4) the official agency date stamp showing receipt of hand delivery.

 

Any decision on this project will not be appealable under 36 CFR 215 or any other authority. The responsible official for that portion of the proposal crossing the TBNG is Dennis Jaeger, Forest Supervisor, Medicine Bow-Routt National Forest and Thunder Basin National Grassland. PUBLIC NOTICE

 

                Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission's (Commission) Procedural Rules and Special Regulations, notice is hereby given of the application of Rocky Mountain Power (RMP or the Company) requesting authority to issue a one-time credit to customers to refund an over-collection of Schedule 191, customer efficiency service charge and to adjust the Category 2 Demand-Side Management (DSM) Surcharge for, as more fully described below.

 

                RMP is a public utility, as defined in W.S. § 37-1-101(a)(vi)(C), providing retail electric public utility service under certificates of public convenience and necessity issued by the Commission.  RMP is subject to the Commission's jurisdiction under W.S. § 37-2-112.

 

                On November 17, 2014, RMP filed its application requesting Commission approval of a one-time customer credit to refund excess funds collected through the small general service (Category 2) DSM Surcharge through the Commission approved Electric Service Schedule 191, Customer Efficiency Service Charge, and to adjust the Category 2 DSM Surcharge.  

 

                Specifically, RMP requests approval to adjust the Schedule 191, Category 2 DSM Surcharge from 2.2 percent to 1.10 percent effective January 1, 2015.   The decrease of the Category 2 DSM surcharge to 1.10 percent will decrease the total revenue to $1.62 million annually.   RMP also requests approval to implement a one-time customer credit for the Category 2 DSM Surcharge of $1.3 million to be applied to each active retail customer in Category 2 beginning February 1, 2015, with an estimated completition of the task no later than March 31, 2015.  RMP stated that approximately 31,500 customers that were subject to the Category 2 DSM Surcharge, Schedule 191 will be the recipients of this one-time customer credit.  The one-time refund amount was determined based on the accumulative balance of the deferred balance account which forecasts the program expenditures through 2014 and its estimated carrying charge.   RMP states that due to the revenues and expenditures being an estimate, the one-time refund of $1.3 million is the recommended amount.  RMP states the primary reason for the one-time customer credit is to provide rate stability for customers by setting the collection rate in line with projected expenditures and then holding that rate steady for 2015.

 

                 In support of its application, RMP states that adjusting the Category 2 DSM Surcharge and implementing a one-time customer credit to the customers that were subject to the Category 2 DSM Surcharge, Schedule 191 will ensure the continued funding of cost effective Wyoming DSM programs and minimize the customer rate impact by aligning Category 2 DSM Surcharge revenues with the currently forecasted program expenditure.

 

                This is not a complete description of the application.  Interested persons may inspect the application during regular business hours at the Company's Wyoming service centers located in Casper, Cody, Evanston, Laramie, Pinedale, Rawlins, Riverton, Rock Springs, and Worland, and at the Commission's offices in Cheyenne, Wyoming, during regular business hours. 

 

                Anyone desiring to file a public comment, statement, protest, intervention petition or request for a public hearing in this matter must file with the Commission in writing on or before January 2, 2015.  Intervention petitions and requests for a public hearing shall set forth the grounds on which they are made and the position and interest of the petitioner in this proceeding.

PLEASE TAKE NOTICE that Stephen Gound has, on the26th day of November, 2014, filed in the office of the Clerk of the District Court, Second Judicial District, in said County and State, a Petition for Ancillary Administration of Estate of Non-Resident Under $150,000.00 for admission of the probate in the State of Wyoming as a probate of this state and for distribution of mineral interests of said estate, and that any objection to said Petition or any dispute concerning the facts stated therein shall be filed with the Clerk of the District Court in and for the Second Judicial District at or before the hearing set on the 30th day of December, 2014, at 8:45 o'clock a.m. in the courtroom, Albany County Courthouse, Laramie, Wyoming.  In the event no objections to said petition or the facts therein or unpaid creditor objections are filed at or before the hearing scheduled herein, the Court shall admit said probate to record in this court and issue a Decree of Distribution as requested in said application.
